The Plain English…
It’s really simple – you are free to download a copy of the photographs offered as wallpaper for your personal use on a personal electronic device (PC, phone or tablet). Simply don’t distribute, upload or copy them to your personal website(s), blog(s) or social media account(s) or otherwise make them available for download. The copyright is retained in all cases by Benjamin Hall.  If you feel the urge to share, pass on the link to this website or use the social links available alongside the images to like and share.

I like to see my photos enjoyed but please note that some are exclusively licensed to stock image companies who do pursue image thieves.

Terms And Conditions Of Use
This is a legal agreement (“Agreement”) between you (“Licensee”) and Benjamin Hall (collectively hereinafter referred to as “licensor”, “copyright holder” or “owner”). By downloading any digital images set to be used on the personal basis from this website, you agree to be bound by the terms of this agreement. If you do not agree, do not submit the download form and navigate away from the page containing the form.

Grant Of License
This website contains digital images that are displayed on the public pages (the “Digital Media”). These include a set of high-resolution digital images labelled as wallpaper (the “Digital Media Wallpaper”). The Digital Media Wallpaper may be downloaded from the respective page for which “wallpaper” is included in the article title by completing the displayed form and accepting these terms and conditions. This License does not apply to Digital Media displayed on the website which is downloaded or obtained by means other than the completion of a form requiring acceptance of this Agreement and which provides an explicit download link.

The Licensor grants to you a non-exclusive, non-sublicensable right to use any of these Digital Media Wallpaper images on your personal computer or personal electronic device. Licensee may not utilize the Digital Media in any manner that is not expressly permitted in this license agreement. Except as specifically provided in this license agreement, no Digital Media may be shared or copied.

Digital Media may only be used in materials for Personal, Non-Commercial, Non-Editorial use. Digital Media may not be used in any commercial or editorial materials including but not limited to, advertising and marketing materials or any online, broadcast or other electronic distribution system and may not be distributed, sublicensed or made available for use or distribution separately or individually and no rights may be granted to the Digital Media or the Digital Media Wallpaper.

No Digital Media may be sublicensed, resold or otherwise made available for use or distribution. For example the Digital Media Wallpaper may be stored on a personal computer or other electronic device for viewing and/or use as a background image or wallpaper but must not be published to other websites, blogs and social media accounts.
Licensor reserves all rights not expressly granted to Licensee herein.
Licensor may revoke this License at any time without reason.

Restrictions
Images may only be used in a personal manner and may not be used for any editorial, commercial, promotional, advertising or merchandising use.
Images may not be used in any defamatory, libelous or otherwise unlawful manner whether directly or in context or juxtaposition with specific subject matter.
Licensee may not sublicense or, sell any of its rights under this Agreement. Licensee may not sell, license or distribute its work in such a way that Licensee’s customer can extract or access the Digital Media as a stand-alone file.
Digital Media shall not be incorporated into a logo, trademark or service mark.
Licensee may not post the Digital Media online in a downloadable format.
Licensee may not transfer this license.
